No. 5512. den 24/6 [17]38(?)

No. 5512, [dated] 24 June 1838.

To the Royal Hanoverian Landdrostei at Hannover.

Most submissive dutiful petition and request of the miller Ludewig Wesemann of Linse, Ducal Brunswick Amt Eschershausen, 21 April 1838. With enclosures A and B.

Concerning a piece of land in the Bodenwerder town fields allegedly sold by the mayor's office.

The late baker Wilhelm Weferling of Bodenwerder, who died fifteen years ago, sold me, at an uncontested arrangement concluded between us on 26 November 1814, a piece of land situated in the Bodenwerder town fields, in the 8th field division under No. 37, for 174 Reichsthaler in gold, on the usual terms. The seller left the purchase price with me because he had no other secure means of investing it, and we agreed that I should hold the land rent-free for as long as it took him to be paid the outstanding purchase price, and that until then I would pay the taxes on it. This arrangement continued unbroken from 1814 through the baker Weferling's death in 1823 and up to the present, since I have not yet recovered from his testamentary heirs the 174 Reichsthaler in gold I advanced in 1814.

In 1822 I then borrowed, from the estate of the children of the late councilman/merchant Grave, a capital sum of 700 Reichsthaler in gold, and executed for it the judicially confirmed bond enclosed as Exhibit A, [registered] with the mayor and council of the city of Bodenwerder. Under item No. 6 of that bond, the above-mentioned piece of land was also pledged to the creditor as security, and I do not know whether this was proper, since it seems to me likely that the bond was not corrected to reflect that the seller's consent to this pledge had not been obtained.

[...]

I must first observe that the Magistrat of Bodenwerder is not fully obliged in every case to issue a legal opinion in the present matter, since the denunciation concerns the standing of the community itself, and under the Land Ordinance of 11 August 1733, [magistrates] are obliged to furnish legal information only in certain matters, where the magistrates are provided with a syndic or secretary alongside the chief magistrate.

[There follows an extended legal argument concerning the burden of proof, the statute of limitations, and jurisdiction between the Magistrat and the Landdrostei, citing the princely ordinances of 9 October 1712 and 6 October 1712.]

I therefore most submissively request of the Royal Landdrostei that the response due from the Bodenwerder Magistrat by the 6th of this month be required and communicated to me for my further information.

Ludewig Wesemann.

On behalf of, E. Rambke, Dr.(?)

Notes

> The 11 August 1733 ordinance cited here is a general Braunschweig administrative statute governing when a Magistrat must respond to legal inquiries. It is unrelated to the mill dispute at NLA WO, 8 Alt Wick, Nr. 63, whose own bound-in 1733 document is a separate item; the two should not be conflated. > > The signature block reading "c. E. Rambke Dr." is uncertain; Rambke may be the advocate who drafted the petition on Wesemann's behalf, consistent with the document being marked Copia throughout. > > The full legal argument (roughly pages 3–7 of the digitization) is dense and repetitive; the passages given here are the substantive narrative and the opening/closing formulae. The intervening procedural reasoning has been paraphrased rather than transcribed in full.

[p.4] ...before the unobligated Magistrat of Bodenwerder brought their denunciation against me on the grounds that I had bought that piece of land from the deceased baker Wilhelm Wäferling for 174 Reichsthaler gold, and that I therefore first cast doubt on the community's claim to the purchase money, since no proof could be shown [...] In support of the matter, at the hearing of the 23rd of last month, the widow Wäferling was examined, for herself and on behalf of her minor children, [and stated] that they knew nothing of the whole affair and that it was not known to her that her late husband had previously possessed the land in question. I declare that I received the said piece of land from the late Wilhelm Wäferling in 1814 for 174 Reichsthaler gold, and that my use of it since has been without doubt [...] That I mortgaged the said piece of land in 1822 to the estate of the merchant Grave, mentioned above, I have never concealed.

[p.6] ...possess a property and my few legal titles, and rightfully or certainly not wrongfully [...] First it is plain that I have in no respect acted against the princely ordinances...

Notes

> These two pages continue the legal argument already summarized in the main petition (Section 2 of this document). No new names or family relationships appear; the content is Wesemann restating and defending the 1814 arrangement and the 1822 mortgage against the Magistrat's doubts.

Exhibit A.

I, the undersigned master miller Ludewig Wesemann, hereby acknowledge and declare that the guardian of the minor son of the late Grave, merchant of Bodenwerder, has given me a loan of seven hundred Thaler in gold from his ward's capital.

This capital is to bear interest at five percent(?) and is to be redeemable by either party on at least six years' notice.

As security for my creditor I pledge my entire estate as a whole, and as preferred recourse specifically the following parcels of land belonging to me and situated in the field-mark of the city of Bodenwerder, namely:

1, one Morgen 71 Ruthen of land in the 6th field division, No. 54.

2, one Morgen 91 Ruthen of land in the same field division, No. 92.

3, thirty-nine(?) Ruthen of land in the same field division, No. 89.

4, one Morgen 92 Ruthen of land in the same field division, No. 60.

5, twenty-three(?) Ruthen of land in the same field division, No. 38.

6, one Morgen 52 Ruthen of land in the 8th field division, No. 37.

7, thirty-four(?) Ruthen of land in the same field division, No. 19.

8, one Morgen 36 Ruthen of land in the same field division, No. 36,

as well as my paternal(?) and eventual property, to which I am entitled under the inheritance contract concluded with my brother, the miller Ernst Wesemann, on 18 August 1818, and its supplement of 3 December 1819, in the following parcels, likewise situated in the Bodenwerder field-mark, on which I owe(?) 2000 Reichsthaler in gold, namely:

1, [one] Morgen 105 Ruthen of land in the 6th field division, No. 53.

2, 115 Ruthen of land in the 8th field division, No. 10.

3, 4 Morgen 91 Ruthen of land in the 7th field division, No. 71.

4, 3 Morgen 77 Ruthen of land in the 8th field division, about No. 43.

5, 8 Morgen 52 Ruthen of land in the same field division, No. 38, and

6, 2 Morgen 95 Ruthen of land in the 9th field division, about No. 87,

which, should they fall to me, shall likewise be drawn on and pledged toward this debt, and separately registered as security for it. This is only to apply once the property in question, at its minimum assessed value within the valuation of my estate, has been permitted at no lower value by the domanial and judicial authorities.

For the security of my creditor, let all of this be fully valid.

Notes

> This is the single most important passage in the file for family reconstruction. Ludewig Wesemann names a brother, Ernst Wesemann, also styled Müller, and dates a private inheritance-division contract (Erbvertrag) between them to 18 August 1818, with a supplementary agreement of 3 December 1819. The property so divided is described as “väterlich” — paternal — though this word is not fully certain at the available resolution and should be re-checked against the original if a higher-resolution image becomes available. > > Neither the Erbvertrag nor its 1819 Nachtrag is part of this file; both are known only from this recital. They would very likely name the father directly and are worth a targeted search, probably at Amt Eschershausen or in a Braunschweig notarial series rather than in a Hannover land file. > > The list of eight parcels pledged outright, plus six more pledged contingently on the Erbvertrag's outcome, gives a partial cadastral map of Ludewig Wesemann's landholding in the Bodenwerder Feldmark as of 1822 — fourteen parcels across the 6th, 7th, 8th, and 9th field divisions, several individually small (under one Morgen), consistent with strip-field holdings typical of the period. > > Ruthen and Morgen counts throughout are best-effort readings from a working-resolution scan; several individual numerals are marked (?) and should be verified against the original before being relied on for area calculations.

On 12 March of this year, Cammerarius Ebell here reported that the petitioner had for a considerable number of years occupied a piece of land in the town fields, for which he could produce no title of purchase or other supporting document [...] Further inquiry showed that the petitioner must have taken over the land in question from the late baker Wilhelm Wäferling, since it had previously belonged to his holdings, as an uncontested acknowledgment drawn up before the domain official Dralle on 26 November 1814 had established, with a purchase price of 174 Reichsthaler in gold.

It is probable that the baker Wäferling, this being an informal transaction, voluntarily ceded the land to the buyer in exchange for its use, without having a deed of sale drawn up or a formal conveyance carried out [...]

Further inquiry showed that the petitioner mortgaged the land in question in 1822 to the guardian of the late merchant Grave's estate for a sum of 700 Reichsthaler gold [...] it ought to have been entered in the town land register under his name. But this land register, under the administration of Cämmerarius Homann, has been lost since 1830, and he has been able to give no further account of it beyond that he does not know what became of it.

[An extended discussion of the statute of limitations and jurisdiction follows, citing the ordinances of 9 October 1712 and 26 January 1753.]

— Schaefer. Bode.

Notes

> This is the Magistrat's first substantive report, and it corroborates Wesemann's own account of the 1814 transaction independently — the acknowledgment before the official Dralle, the 174 Reichsthaler price, and the informal nature of the transfer. > > The loss of the town land register (Landcataster) since 1830, under Cämmerarius Homann's administration, becomes a recurring point in the later exchanges (see page 16) and is one of the file's genuine administrative loose ends — nobody in this file can say definitively when or whether Wesemann's name was ever formally entered as titleholder. > > No family information appears in this report beyond what the earlier documents already establish.

I. Allgemeiner Sachverhalt.

I. General statement of the facts.

On 26 November 1814, the farmer Georg Grave of Landeswanden sold my late father, the baker Wilhelm Wäferling, a piece of land in the 8th field division, No. 37, for 174 Reichsthaler gold, on the usual terms [...]

The miller Ludewig Wesemann the elder of Linse, Ducal Brunswick Amt Eschershausen, is said to have used this land from 1814 to the present, and to have improperly mortgaged it in 1822, with the sanction of the worthy Magistrat of Bodenwerder, to the heirs of the late merchant Grave.

II\. Grounds of standing and jurisdiction.

Notes

> This is the Weferling heirs' first formal appeal, running roughly nine manuscript pages (19–27) and structured in numbered legal sections. The opening — Section I — is the fullest narrative statement in the entire file of how the 1814 transaction came about, and it is the only place that names the seller of the land to Wäferling in the first instance: “der Ökonom Georg Grave zu Landeswanden.” This Georg Grave, a farmer at Landeswanden, appears to be a different, and presumably older, member of the same Grave family whose estate later held the 1822 mortgage — the file gives no indication of the relationship, but the recurrence of the surname across both ends of the transaction is worth noting. > > “der Müller Ludewig Wesemann der ältere zu Linse” — “the elder” — recurs here exactly as first flagged. No younger Ludewig Wesemann is named or otherwise identified anywhere in this file. > > The bulk of the intervening argument (Sections II–IV, most of pages 20–26) concerns burden of proof, statute of limitations, and jurisdictional competence between the Magistrat and the Landdrostei, citing repeatedly the ordinances of 9 October 1712 and 26 January 1753, and Latin legal maxims (Institut. de perpetuis et temporalibus actionibus; Cod. de defunctis defunctorum). None of this bears on family relationships. > > The Bodenwerder testimony recorded within this brief (page 20) is the closest thing in the file to a deposition: at the hearing of 23 March 1838, the widow Wäferling stated she knew nothing of the matter, and Wesemann himself, examined separately, stated that he had received the land in 1814 from Wäferling for 174 Reichsthaler and had treated his free use of it as standing in place of interest on the unpaid price — essentially repeating, in his own examined words, the account already given in his petition.

[...] I justify [my response] to the Rekurs petition received in April of this year [...] The unobligated Magistrat of Bodenwerder has linked the grounds of its ruling to an earlier finding of its own regarding an agreement between the late baker Wilhelm Wäferling and myself concerning the land in question, on the basis that I mortgaged it to the Grave estate in 1822. That this inference cannot be sustained on the grounds given, I have already shown in my Rekurs petition [...]

[...] The Magistrat of Bodenwerder places weight on the fact that the land register went missing between 1822 and 1831. This circumstance can by no means serve as grounds for treating the disputed transaction as not having taken place. On the contrary, one must conclude from the Magistrat's own confirmation of the mortgage bond that the late baker Wäferling, under the admittedly mistaken belief that the land remained my property only until the advanced purchase money was repaid to him, must have voluntarily agreed, with my consent, that the Magistrat enter my name in the land register.

[...] I therefore most submissively request of the Royal Landdrostei: to direct, in reaching a decision in this matter, that the denounced party's claim to the said landed property be dismissed with the Magistrat's assistance.

Ludewig Wesemann.

Notes

> Wesemann's second personal filing, responding point by point to the Magistrat's 7 May report. He argues — plausibly — that the Magistrat's own 1822 confirmation of his mortgage bond (which named the disputed parcel) is itself proof that Wäferling consented to the arrangement, since the Magistrat would not otherwise have let the pledge stand unchallenged. No family content beyond his own name and the same recurring signature formula.

These are very likely two different men sharing a common local surname — flagged here rather than resolved, since the file does not distinguish them explicitly.

Executed at Bodenwerder, 5 July 1838.

In the denunciation proceedings of Cammerarius Ebell here, denouncing party, against the sons of the late baker Wilhelm Wäferling here, and likewise the miller Wesemann of Linse, denounced parties, concerning the presumed sale of a piece of land in the town fields here.

To the attorney of the co-denouncing parties, namely the sons of the late baker Wilhelm Wäferling: in the Rechtfertigung des Rekurses submitted to the Royal Hanoverian Landdrostei on 19 May of this year, page 8, it was raised as a defect of the investigation that not all of Wäferling's sons had been examined regarding the grounds of the denunciation; but this objection must itself appear striking, since all the sons of Wäferling had appointed their brother, and respectively cousin, Heinrich Wäferling as their agent in this matter, and had fully empowered him to represent their rights [...]

It appears that in response the said miller [Wesemann] went entirely to his attorney, Dr. Dralle, who then produced the power of attorney dated 3 and 4 April of this year [...]

6\. On this account, both the rejoinder and the miller have now stated, and each must expressly declare in his own name, that none of them had known anything of the land dealings with the miller Wesemann before this. How the attorney came to raise the objection made in the Rechtfertigung, he does not know, since he as well as his clients and their siblings had likewise maintained that they knew nothing of the whole matter.

The court thereupon informed the appellant that his clients and their siblings, insofar as they had never raised any objection in this matter, were to appear at the town hall on the 10th of this month in the morning, and that, should they fail to appear, it would be assumed they had no further objection to raise. The agent declared that he would communicate this to his clients in the proper legal manner, and requested and was granted a copy of the protocol.

Executed as above.

In witness,

Schaefer, Dr.

Notes

> This is the Bodenwerder court's procedural decree resolving the standing dispute between the two sides' attorneys — it confirms Heinrich Wäferling's power of attorney was dated 3–4 April 1838 and rules that his mandate covers all the Wäferling heirs, dismissing the objection that not every son was individually examined. > > No new family names beyond those already established: the Wäferling brothers/cousins and Wesemann's attorney Dr. Dralle.

No. 9381. den 20/7 38. W.

No. 109, ad No. 6743 & 8076.

No. 9381, dated 20 July 1838. W.

To the Royal Hanoverian Landdrostei at Hannover.

Concerning the Magistrat of Bodenwerder's report of 16 July 1838 on the investigation against the sons of the late master baker Wilhelm Wäferling there and the miller Ludewig Wesemann of Linse, regarding the concealed sale of a piece of land.

In response to Your Honour's earlier rescripts of 21 May and 24 June of this year, No. 6743 & 8076, we have continued the investigation of the remaining matter as far as possible, examining the claim of the late baker Wilhelm Wäferling as thoroughly as we could, drawing also on the protocol of 30 June, appended here as document No. 15.

Cammerar Dralle has indeed observed that [the case] was not pursued so strictly against the baker Wilhelm Wäferling, the denounced party, as his express intention to favourably assign the land in question to his designated heirs would suggest [...] while the widow of the late baker Wilhelm Wäferling, for her part, has denied any knowledge of the matter, [stating] that she certainly would have raised a claim outright for repayment of the purchase money as a loan or advance, had she known of it [...]

By contrast, the miller Wesemann's justification — that he regarded his longstanding possession of the land in question as a purchase — requires no further correction, since it is beyond dispute that he duly mortgaged that land to the heirs of the late merchant Grave, and this mortgage itself implies that the land was recognized as his in the register that has since been lost.

It therefore remains, in our considered judgment, that the miller Wesemann is to be regarded merely as a participant, whose own share of the claim stands no differently from what would similarly fall to the sons of the late baker Wäferling [...] in any case, the sons of the baker Wäferling must be held, under the rule de credulitate defendendi [regarding the good faith of the party pleading], not to have further disputed that their father, to the best of his knowledge and belief, received no repayment or payment in money from the miller Wesemann upon ceding the land in question.

We accordingly consider the Rekurs of the sons of the baker Wäferling, together with the corresponding appeal of the miller Wesemann, to be duly substantiated, and respectfully forward herewith the file, consisting of seventeen numbered items.

Schaefer. Bode. G. H. Magedorn.

Notes

> This is the Magistrat's final and most consequential report — the one your project's earlier summary already identified as leaning toward treating Wesemann as a mere “Theilnehmer” (participant) rather than the responsible party, now confirmed in full. > > The Magistrat's reasoning is notable: it treats Wesemann's 1822 mortgage of the parcel as itself proof that his possession was recognized as ownership at the time, since the Magistrat had confirmed that mortgage — an argument that favours Wesemann. > > Three signatories here: Schaefer, Bode, and G. H. Magedorn — a name not seen elsewhere in the file. > > This report is not a final ruling on title; it recommends the case forward to the Landdrostei with the full file of seventeen exhibits, which is where the surviving digitization ends.
